Developers in Lagos are facing a tough reality as regulatory compliance and approval costs now gulp nearly 30% of total project expenses. Industry experts reveal that obtaining a building permit is only the beginning of a multi-stage, costly journey required by state agencies like LASPPPA and LASBCA.

Here is a breakdown of the key findings from built-environment professionals:

  • Planning Permit Is Not Enough to Build: Developers often make the mistake of commencing construction immediately after securing a Lagos State Physical Planning Permit Authority (LASPPPA) permit. However, physical work cannot begin without a Letter of Authorisation to Build and a green sticker from the Lagos State Building Control Agency (LASBCA). Sites lacking these are regularly sealed, leading to costly project halts and accumulating bank interest.

  • Costs Depend on Four Major Factors: Official assessment fees are not flat rates. They are determined by:

    1. Location (Zones): Prime locations like Zone 1 (Ikoyi, VI, Lekki) attract significantly higher charges than Zone 3 (Ikorodu, Alimosho) or Zone 4 (Epe, Badagry).

    2. Land Use: Commercial projects face higher fees and additional levies (like the Infrastructural Development Charge) compared to residential builds.

    3. Building Size & Volume: Calculated from structural dimensions.

    4. Number of Floors: Taller structures attract extra technical reviews, inspections, and stage certifications.

  • The Five-Stage Regulatory Process: Compliance costs accumulate across five main phases:

    • Pre-application: Professional fees (architects, engineers, town planners) and site documentations (EIA, LUPAR, soil test reports).

    • LASPPPA Approval: Statutory assessment fees, Spatial Enhancement Contributions (SEC), LASEMA levies, and processing charges.

    • Construction Authorisation: LASBCA authorization, Contractors’ All-Risk Insurance (for builds with 3+ floors), and introducing consultants.

    • Stage Inspections: Periodic site checks (foundation, decking, roofing) by LASBCA, material testing by LSMTL, and stage certification fees (roughly 35% of the processing fee).

    • Final Certification: Post-construction safety, fire, and utility clearances to obtain the Certificate of Completion and Fitness for Habitation.

  • Delays and Contingencies Drive Costs Up: Processing queries, drawing revisions, resubmissions, and failed site inspections add substantial hidden expenses. Experts advise developers to set aside a 20% to 30% contingency budget specifically for unexpected regulatory delays, professional fees, and amendments.

  • Regulatory Changes Since 2020: The splitting of functions between LASPPPA (planning permits) and LASBCA (building control) has introduced separate processes and additional payments. Coupled with rate hikes in 2024, new levies, and mandatory digital processing, overall compliance costs have surged.

  • Impact on Housing Supply: These regulatory hurdles come at a time when Lagos faces a 3.4 million-unit housing deficit, requiring over N6 trillion annually to bridge the gap. Combined with sky-high land prices—reaching up to N3.05 million per square metre in Victoria Island—these accumulated compliance costs ultimately push up property prices and rent, forcing some residents to spend 60% to 70% of their income on housing.
